Summary of the Strike-Everything Amendment to SB 1060

Overview

Prohibits public institutions of higher learning in Arizona from accepting or maintaining funding, agreements or partnerships from specified entities. Establishes procedures for the Arizona Board of Regents to review such cooperation with specified entities. Outlines budgetary penalties for institutions that accept or maintain the prohibited collaborations.

History

The Arizona Board of Regents (ABOR) governs Arizona's three public universities and is tasked with exercising the powers necessary for the effective governance and administration of the universities, including authorizing each university to adopt regulations, policies, rules or measures deemed necessary for the universities' administration and governance. ABOR may also delegate any part of its authority to the university presidents or other entities under its control, though ABOR may rescind any delegation of authority at any time (A.R.S. § 15-1626).

Provisions

1.   Prohibits a public institution of higher education in Arizona from knowingly soliciting, accepting, entering into or continuing any loan, gift, grant, contract, agreement, research partnership, memorandum of understanding or sponsored project that originates from, is funded by or is affiliated with outlined entities. (Sec. 1)

2.   Requires any proposed acceptance of monies, support or collaboration with outlined entities to be submitted to ABOR for review and written approval before the acceptance of monies, support or collaboration may occur. (Sec. 1)

3.   Designates ABOR as the sole reviewing and decision-making authority for determining whether the acceptance of monies, support or collaboration is consistent with state law, national security interests and the public interest of Arizona. (Sec. 1)

4.   Prohibits a public institution of higher education from delegating, bypassing or presuming approval authority as prescribed by the act. (Sec. 1)

5.   Classifies any unapproved agreement with outlined entities as void and unenforceable. (Sec. 1)

6.   States that if ABOR approves an acceptance of monies or an agreement and the acceptance or agreement is later determined to not comply with the act's prohibition or the ABOR-review, the applicable public institution of higher education is required to forfeit an amount equal to 150% of the total value of the monies, gift or agreement. (Sec. 1)

7.   Specifies from which part of an institution's operating budget the forfeited amount must be reduced and to where the forfeited monies be deposited. (Sec. 1)

8.   Prohibits the Legislature from increasing or decreasing an appropriation to the applicable institution to offset the forfeiture. (Sec. 1)

9.   Directs ABOR to establish a subcommittee, advisory board or similar entity to review and approve any proposed monies, support or collaboration between an ABOR university and an outlined entity or entities. (Sec. 1)

10.  Requires ABOR to adopt reporting requirements for universities under its jurisdiction and specifies the formatting and examinability of the reports. (Sec. 1)
